Buying Firearms
Auction Process & Inspection
All firearms are sold on consignment. Our auctions include both brand new firearms and used guns, which may vary in condition. Our team is available before each auction to answer questions and provide information on listed firearms. All items are sold as-is, with no returns or guarantees unless otherwise stated in the auction listing.
Bidding:
All bidding for firearms is conducted online in real time. Review our How to Bid & Buy page for step-by-step instructions.
Pre-Auction Preview:
Buyers are welcome and encouraged to inspect firearms in person at our Nampa or Meridian locations before bidding.
Legal Requirements
Firearm purchases are highly regulated. Before placing a bid, it’s important to understand the steps you’ll need to follow to complete your purchase legally and without delays—whether you’re buying in Idaho or from out of state.
For In-Person Buyers In Idaho
- Background Checks: All firearm sales require a federal background check using the FBI’s National Instant Criminal Background Check System (NICS). If you have a valid Idaho Concealed Weapons License issued in the last 5 years, you may qualify for an exemption. This check ensures you’re legally eligible to purchase firearms and helps keep the auction process compliant and safe for everyone.
- Complete Form 4473 Onsite: The Firearms Transaction Record must be filled out in person at our licensed facility in Nampa or Meridian, in accordance with federal law and ATF regulations
- Age Requirements: Minimum age is 18 for long guns and 21 for handguns. For ammunition purchases, Idaho law (Section 18-3308) prohibits the sale or gifting of ammunition to minors under 16 years of age without written parental or guardian consent—except for shotgun shells or .22 caliber rifle rounds. We enforce this restriction in compliance with state law.
For Out-of-State Buyers
-
Handguns: By federal law, handguns must be shipped to an FFL in your state of residence. You must provide us with your local dealer’s FFL information prior to shipment. We recommend using ffls.com to find a licensed dealer near you.
-
Long Guns: In accordance with federal law, many long guns (rifles and shotguns) can be purchased and transferred to out-of-state buyers if state laws allow. Please confirm your state’s regulations before bidding.
- Compliance with Your State Laws: Some firearms legal in Idaho may be restricted or prohibited elsewhere. Your chosen FFL is responsible for verifying compliance before completing the transfer.
- Prohibited States: While some transactions might be legally permitted, we do not ship to California or New York to avoid regulatory conflict and ensure compliance. We appreciate your understanding.
After the Auction
Once the bidding ends, we keep the process simple and straightforward. Here’s what to expect next:
- Payment: Payment is required within 72 business hours. Firearm shipments require certified funds—typically a form of payment that cannot be reversed or charged back, such as a cashier’s check or wire transfer.
- Pickup & Shipping:
- Local Buyers: Pickup is available at our Nampa and Meridian locations after completing required paperwork and passing a background check.
- Out-of-State Buyers: After we receive payment and verify your FFL’s credentials, we’ll coordinate shipping to your dealer on a case-by-case basis. Active communication with your receiving FFL is key to ensuring a smooth handoff and timely pickup.
What If You Fail a Background Check But Have Already Placed a Bid?
If you win a bid but are later unable to pass the required background check, please be aware that the sale is still considered final. Because many of our sellers are individuals consigning a single item, we cannot offer refunds without disrupting the integrity of the auction process.
However, we won’t leave you stranded. We’ll relist the firearm on your behalf in a future auction, subject to our standard consignment rates. This ensures you still have an opportunity to recover value from your purchase while keeping the process fair for all parties involved.
Selling Firearms
Whether you’re an individual selling a single firearm, managing an estate with a mixed collection, or liquidating assets from a business or agency, Musick Auction offers an experienced and legally compliant consignment process that removes the guesswork—and the liability—from private firearm sales.
Why Work With a Licensed FFL Dealer?
Federal law requires any business that receives or sells firearms—even temporarily—to be licensed by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). As a federally licensed firearms dealer (FFL), Musick Auction can legally accept, store, and transfer firearms through auction—ensuring full compliance with ATF and state regulations every step of the way. This is especially important in estate or multi-party scenarios where ownership transfer must be handled carefully and properly documented.
Our Firearm Consignment Process
- Intake: Drop off your firearm at one of our licensed facilities. We’ll verify the serial number, assess its condition, and log it into our ATF-bound book.
- Secure Storage: Your firearm is safely stored in our controlled facility until auction day.
- Photography & Marketing: We professionally photograph and list your item with clear details and condition notes to attract serious bidders.
- Auction & Sale: Your firearm is sold to the highest bidder—either in person or online. All buyers are required to complete a background check or FFL transfer.
- Payment & Payout: Once the transaction is complete, we process your payment minus our standard consignment fee.
